School districts continue to believe that the Transgender school policy must include parent deception. NJSA 18A:36-41(b) directs the commissioner of Education to develop and distribute school district guidelines. This DOES NOT require schools to follow these guidelines.
The truth is, there is no legal authority that requires a district to adopt the 2018 NJDOE Transgender Guidance For School Districts (often titled Policy 5756 in districts). A district is free to develop its own policy on this issue.
Recently, Mantua township school district announced its transgender policy allowing students of any age to change their name and gender without parental permission or proof of any kind. The Mantua policy forces teachers and students to call these kids by their preferred gender and pronouns with disciplinary action for those who refuse. As stated above, THIS IS NOT A STATE LAW AND THE BOARD DID NOT HAVE TO ADOPT THESE GUIDELINES.
Additionally, Mantua sites Title IX to support their policy that allows biological boys access Girl’s locker rooms and restrooms, putting girls in a potentially unsafe situation.
