LEGAL REPORT: THE BATTLE FOR PARENTAL RIGHTS IN NJ SCHOOLS
Ron Berutti filed a massive federal complaint today, Lema et al. v. Davenport et al., taking a blowtorch to the state’s “Gender Identity and Expression” policies. The lawsuit seeks a temporary restraining order to stop NJ state actors and boards of education from socially transitioning minor children behind their parents’ backs. The five districts named in the complaint are:
Hackensack
Newark
Burlington Township
North Hunterdon-Voorhees Regional
Bethlehem Township
The core of the argument is simple: fit parents have a fundamental right to direct their child’s upbringing, and schools are currently operating a “secret” system that cuts parents out of life-altering psychological decisions. The most insidious part is that you would never even know if it was happening. Most of these townships rely on the language of Policy 5756, which explicitly states that the school has “no affirmative duty” to notify a parent about a student’s gender transition. This isn’t just a lapse in communication; it’s a policy of state-mandated deception.
The Statutory Stretch of the NJLAD Law
The state tries to keep this policy in place by leaning on the New Jersey Law Against Discrimination (NJLAD) for justification, but their legal logic is weak at best. NJLAD was built to handle employment, housing, and public accommodations. It was never a license for school districts to hide medically and psychologically significant information from parents. This leap from workplace anti-discrimination to “secret” school transitions isn’t just a legal reach; it’s a complete departure from the school’s historical role. Using a labor law to kidnap parental rights is a jurisdictional hallucination.
From Online Memes to School Mandates
From the era of the first American schoolhouses until today, teachers never had the job of directing the social transition of children. This is a radical departure from the historical role of the educator. It is a modern invention, seemingly born from an outrageous online culture that prioritizes the extreme fictions of gender ideology. These 21st century policies didn’t emerge from parents, pediatricians, or child psychologists. They were written by academics whose theories have never survived contact with an actual child, laundered through activist organizations, and handed to school districts as settled law.
As Douglas Murray points out in The Madness of Crowds, we are watching a massive, untested social experiment play out in real time. These concepts weren’t even a blip on the radar fifty years ago. Murray correctly bridges this shift to a toxic online ecosystem where identity has become performative and viral. The policies didn’t arrive through open debate; they were adopted while parents were locked out. Literally. During COVID, kids were home, board meetings were closed to the public, and districts quietly passed gender identity policies with zero community input or objection. No one knew it was happening because no one was permitted in the room. As the public finally wakes up to this administrative overreach into the minds of children, school officials somehow missed the memo. They are still using their positions to act as moral monitors for a child’s coming-out timing and gender questioning. This is NONE OF THEIR BUSINESS.
Mantua Superintendent Christine Trampe posted on Facebook about being called a pedophile, and while that specific word is technically inaccurate and harsh, the instinct behind it isn't irrational. People aren't making a sexual accusation. They are reacting to a pattern that every child safety expert teaches kids to recognize as dangerous: an adult in a position of authority, cultivating a secret with a child, about something deeply personal, while actively keeping the parents out. The intent may differ but the boundary architecture is identical. That is why people reach for the strongest language they know. The objection is specifically this: schools teach gender identity, and then administrators facilitate social transitions (a psychotherapeutic intervention) while keeping parents completely in the dark. That is a clinical decision, and you are not a clinician; you are an administrator. A child being scared to tell their parents something is not a transfer of authority to the school. Your job is to notify the parents that their child is struggling so they can seek professional help, not to manage a child's secret life.
Adolescents keeping secrets from their parents is developmentally normal. Every parent who has ever picked up a copy of anything by Piaget, Erikson, or even a basic parenting guide knows that adolescent secrecy is a developmental stage, not a crisis requiring administrative intervention. It is not an invitation for the school to become a co-conspirator in that secret. The same developing brain that makes a teenager prone to secrecy is the exact same brain that cannot fully comprehend irreversible medical consequences. That is the argument for parental involvement, not against it. Using normal adolescent development as justification for cutting parents out permanently isn't compassion. It's negligence.
Let's be clear about what social transition actually is: it is the preparation for medical transition. You cannot actually change your sex; you can only play pretend and enhance the experience with cosmetic medical intervention. You CANNOT change your DNA. Messing with kids who aren't developmentally capable of understanding the implications of these decisions is reckless. This isn't just a name change; it is a psychological and clinical intervention where a child lives as the opposite gender to prepare them for medical transition. Social transition is not the alternative to medical transition. It is the on-ramp. It is the first step down a dangerous path toward drugs and life-altering surgeries. Each of the consequences that follow deserves to be stated plainly. Pumping cross-sex hormones into a body that was not designed for them disrupts the entire endocrine system and is known to cause cancer and shorten life expectancy. Beyond those risks, surgically altering genitals carries a risk of permanent loss of the ability to have children or even experience an orgasm. These are harsh, irreversible consequences, and they aren't yours to initiate, Christine.
To the Boards of Education and School Administrators of New Jersey:
The window for claiming ignorance is closed. You are now on notice: your adherence to “no affirmative duty” policies is a direct violation of the constitutional rights of fit parents. When you manage a child’s “secret life,” you are not being a “safe space”… you are driving a wedge between children and their families, leading them down a path to irreversible medical consequences. Your job is to support the family unit, not to replace it. Stay in your lane, respect your professional boundaries, and stop the state-mandated deception. The “secret” is out, and the legal reckoning has arrived. Let the parents of your district parent, and…
Keep your eyes on your own kids.

What a fantastic article. It accurately and succinctly lays out our argument for schools to stay in their own lane. This case could go all the way to the Supreme Court. I pray it succeeds.
You hit the nail on the head. The role of an educator is to provide a safe environment while imparting knowledge to her students. Unfortunately, the demands of an educator have been drastically redefined with little to no training, as well as teachers being forced to follow board policies that are antithetical to a collaborative working relationship between parents and teachers. Jobs and livelihoods are on the line for staff members who follow their conscience instead of policy. Public schools are headed down a dark path with policy 5756, so this is a step in the right direction for parents and teachers caught in the middle of these despicable mandates from the schools.
