SAMPLE LETTER DECLARING CHILD IS EXEMPT FROM MASK USAGE BY AUTHORITY OF THE PARENT

Dear Dr. (SUPERINTENDENT NAME) and(DISTRICT NAME) School Board:
Please be advised that I am the mother of (CHILD). My son is a rising (GRADE)grade student at (SCHOOL NAME).
CHILD has been supported and evaluated by the ISR team since September 2020. As you may be aware, I previously requested the ISR team conduct an IEP evaluation. The ISR team recommended delaying implementation of any IEP plan. Relying upon the recommendation, we halted our own efforts to obtain a 504 designation.
Over many conversation, emails and meetings, I have advised that I will not consent to any future masking requirement for CHILD as a condition of his receipt of an in-person education. Although the District’s existing LEA Draft Plan contains a potential for parental choice, I have little confidence and trust that the Draft Plan will survive beyond the November 4th election season.
I have previously advised that I observed significant speech regression during CHILD’s extended mask-wearing beginning March 22, 2021. CHILD suffered multiple nosebleeds throughout the end of the 2020-2021 School Year. I observed additional issues related to masking, including but not limited to daily mask saturation (even though I provided him with three clean masks per day), his inability to hear and observe the articulation of sounds through interpreting visual cues from facial impressions, and the distraction and discomfort that comes with struggling to breathe through a soggy cloth.
He also developed a noticeable nasal strain or snorting issue. CHILD no longer attempts to blow his nose, after months of mask usage, as he grew accustomed to snorting any mucus back into his throat. I am having him monitored by his pediatrician and allergist for this condition.
Accordingly, at this time, I respectfully advise that as CHILD’s parent and lawyer, he is medically exempt from any medical intervention requiring use of an experimental mask or face shield product as a condition of in-person instruction through the District.
Should you request documentation from any medical provider in order to affirmatively guarantee the exemption declaration will be honored, my husband and I will require a written response to the following:
"The community has not been provided credible justification or response from our school officials in determining whether masks will be required at school. Rather, we are told that our school officials are "following" what those of higher powers (i.e., CDC, NJDOH, NJDOE, HCHD, AAP, Governor Murphy) have told them to implement for the "safety" of our community.
If masks are required at any time from the start of the 2021 school year, school officials will be forcing children to comply with medical interventions granted emergency use authorization (EUA) by the FDA during COVID-19.
What does this mean?
It means as a medical purpose to assist in mitigating and preventing the spread of infectious materials, school officials would require the mouth and nose of a child be covered with an unapproved medical device (facemask, cloth face-covering) with an unapproved/uncleared use (source control), without informed consent.
There are no long-term safety trials or clinical studies for daily use by children.
The reality is that since March 2020, due to the unprecedented circumstances, our country and state have administered a rapid response in the universal implementation of face masks without any differentiation between adults, adolescents, and children. It was apparent that the moral reason to obtain free and voluntary informed consent prior to administering a medical intervention was outweighed. Most of us, myself included, complied without sufficient understanding, so that our children could receive an in-person education.
However, things are different now. We have sufficient understanding. There is existing data to establish masking children is unnecessary and harmful. There is plenty of evidence of the negative effects of the immunological and psychological level of forcing children and adolescents to wear a facemask, which outweighs the potential gains.
School officials throughout NJ have been granted the ability to make decisions for their district. If masks are required, it can be assumed that our school officials feel it is morally permissible to carry out non-consensual medical interventions using compulsory or coercive measures for the purpose of infection disease control. One of the most valuable rights our children have under the Constitution, is the right to receive a free and public education.
Choices regarding health are a civil right grounded in bodily autonomy, dignity, and privacy of the individual. The profound lack of dignity, privacy, autonomy, and treatment of children under the age of (12), who are ineligible for a medical intervention under EUA is appalling and discriminatory. The civil right to bodily autonomy with respect to a particular act if it is carried out must be with intention, understanding, and without controlling influences that determine the action. There is no law requiring masks, nor is there a law preventing masks optional.
As concerned parents, we are requesting answers to the following:
Data that provides proof in which masks benefit the children in our district physically and medically.
Proof that masks cause no harm to the students emotionally, mentally, and physically.
A tally from the nurse’s log of the number of incidences of mask-related problems for the 2020-2021 school year including but not limited to:
Headaches, migraines
Lethargy, fatigue
Bloody nose
Skin lesions, rashes, and acne on the face
Skin breakdown behind the ears
Poor dentition – increased cavities, mouth sores, abscesses, canker sores
Reduced ability to concentrate
Cognitive decline
Exacerbation of mental health issues, including anxiety and depression
Difficulty breathing, shortness of breath
Difficulty learning
Heat exhaustion, heat-related illness
A school study that shows the communication between students, teachers, and peers have not been adversely affected by masks.
Proof the children with 504’s and IEPs have not declined in learning for the 2020-2021 school year.
It is not our responsibility to prove masks are not safe. It is up to you to prove that they are safe. The null hypothesis is that any new intervention is unsafe until proven safe"
I request written confirmation that the District will honor our declared exemption notice no later than August 17, 2021.I must receive your timely response, so that I may seek further relief, if such relief is necessitated.
